1. Introduction
These Terms and Conditions ("Terms") govern your use of the WorkFirst platform ("Service") operated by WorkFirst. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
These Terms are intended to comply with applicable European Union law, including the Consumer Rights Directive (2011/83/EU), and Finnish law, including the Finnish Consumer Protection Act (Kuluttajansuojalaki 38/1978, as amended) and the Finnish Act on the Provision of Digital Services (Laki digitaalisten palvelujen tarjoamisesta 306/2019).
2. Definitions
- Service: The WorkFirst prove & hire platform, including the website and related services.
- User: A natural or legal person who uses the Service (workforce or company).
- Account: The registration and associated access to the Service.
3. Eligibility and Registration
You must be at least 18 years old and have the legal capacity to enter into binding contracts to use the Service. By registering, you represent that the information you provide is accurate and that you will keep it updated. We may refuse or suspend accounts that violate these Terms or applicable law.
4. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Violate any applicable national or international law or regulation.
- Infringe the intellectual property or other rights of WorkFirst or third parties.
- Transmit harmful, offensive, or illegal content.
- Attempt to gain unauthorized access to the Service or other users' accounts.
- Use the Service in a way that could damage, disable, or overburden the Service.
5. Account Types and Obligations
Workforce users agree to submit genuine work and to comply with task requirements. Company users agree to evaluate work fairly and to comply with applicable employment and contract law. Both parties are responsible for their own tax and legal obligations.
6. Intellectual Property
WorkFirst and its licensors own all rights in the Service (including software, design, and content). You retain ownership of content you submit. By submitting content, you grant WorkFirst a non exclusive, royalty free licence to use, store, and display it as necessary to provide the Service.
7. Limitation of Liability
To the fullest extent permitted by applicable law (including mandatory consumer protection in the EU and Finland), WorkFirst shall not be liable for indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or where such limitation is not permitted by law.
8. Withdrawal and Cancellation (Consumers)
If you are a consumer within the meaning of EU/EEA and Finnish consumer law, you may have a right of withdrawal from distance contracts within 14 days under the Consumer Rights Directive. For digital content and services, your right of withdrawal may end once performance has begun with your prior consent. Specific terms will be provided where required by law.
9. Termination
You may close your account at any time. We may suspend or terminate your access if you breach these Terms or for other legitimate reasons, with notice where reasonably possible. Upon termination, your right to use the Service ceases immediately.
10. Changes to the Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on the Service and updating the "Last updated" date. Continued use after the change constitutes acceptance. Where required by EU or Finnish law, we will obtain your consent to material changes affecting consumers.
11. Governing Law and Disputes
These Terms are governed by the laws of Finland. For consumers, mandatory consumer protection law in your country of residence may apply. Any dispute shall be submitted to the courts of Finland, unless EU or Finnish law requires otherwise (e.g. consumer dispute resolution or the consumer's local courts).
